Authorised Representative
Do you sell your products through Amazon, eBay, AliExpress or any other sales channel? Do you sell your products to consumers in the EU? Is your company based outside the EU?
If your answer to these questions is yes, you must appoint an authorized representative in the EU.
Regulation (EU) 2019/1020 on market surveillance and compliance of products (MSR Regulation) entered into force on 16/07/2021.
The European Commission adopted the Market Surveillance Regulation (MSR) to ensure the safety of products supplied within the European Union.
Its goal is to verify that items sold on the EU single market adhere to EU regulations.
All non-EU manufacturers must have an EU-based “economic operator”.
An economic operator can be one of the following:
- a manufacturer
- an importer
- an authorized representative
- a fulfilment service provider (person or company responsible for warehousing, packaging, addressing and/or dispatching products).
Economic operators are responsible for ensuring the availability of compliance documents. They are required to support and cooperate with authorities in charge of market surveillance during an investigation and notify authorities when there are reasons to believe a product placed on the market is potentially harmful.
The MSR applies to ‘sector-specific legislation’ including the safety of toys, electrical equipment, radio equipment, electromagnetic compatibility, restricting hazardous substances in electrical and electronic equipment (‘RoHS’), energy-related products (‘ecodesign’), gas appliances, construction products, machinery, outdoor equipment (‘outdoor noise’), equipment for use in potentially explosive atmospheres (ATEX), pressure equipment, simple pressure vessels, pyrotechnic articles, recreational craft, measuring instruments, non-automatic weighing instruments, personal protective equipment and unmanned aircraft systems.
